Federal Lawsuit Filed to Block Controversial Alabama Abortion Law

Planned Parenthood and the American Civil Liberties Union are attempting to block Alabama’s new abortion restrictions. The organizations filed a lawsuit on behalf of abortion providers earlier this week in federal court. The Alabama law, along with several proposed laws in other states, seem intent upon challenging Roe v Wade in the Supreme Court.

Alabama’s new law essentially outlaws all abortion, except in cases where the health of the mother is at risk. Abortions at any stage of the pregnancy would be outlawed, with abortion providers facing a potential penalty of life imprisonment. The law is set to take effect in November.

The lawsuit filed by the ACLU and Planned Parenthood asserts the Alabama law directly conflicts with the Supreme Court’s Roe v Wade decision. “For over 46 years — since the Supreme Court decided Roe v. Wade — U.S. law has recognized the fundamental constitutional right to make the profoundly important and personal decision whether or not to terminate a pregnancy,” the lawsuit states.

Supporters of the new law hope the addition of Brett Kavanaugh and Neil Gorsuch to the Supreme Court will allow for Roe v Wade to be overturned. Some Republicans have criticized the wisdom of pursuing such a legal confrontation just prior the 2020 election, with multiple GOP politicians distancing themselves from the law. Although the restrictions may be popular among the electorate of some districts across the country, the general political consensus seems to believe the fight will hurt Republicans going into the 2020 election.
